Good news for people who held or had applied for a Subclass 457 visa on 18 April 2017 which was subsequently granted – the government has slightly relaxed the regulation that requires applicants to have been employed in their nominated position for a minimum of 2 years.

For them, where a nomination is lodged for permanent residence under the Temporary Residence Transition (TRT) stream of the Subclass 186/187 visa on or after 18 March 2018, and at any time until 18 March 2022:

• Occupation list requirements will not apply; and
• The minimum period an applicant is required to have been employed in their nominated occupation/position as the holder of a subclass 457 or TSS visa will remain at two years. However, decision makers can accept 23 months as having satisfied this requirement.

This means applicants will not be disadvantaged if it so happens that their 457 visa would expire a few days short of meeting the two-year work requirement.

Potential applicants should also note that the Subclass 187 visa will soon be replaced by a new regional visa, Subclass 494, on 16 November 2019 (read more about this in our previous Newsflash here)
